New ideas are the foundation for many Texas businesses. As a company develops a new idea or a new product, the company will often apply for a patent as a protective measure. The patent offers protection to the company in that any other company that attempts to utilize the same idea or product will need to go through the company that developed it. When this does not happen, there could be a patent law infringement issue.
Recently, a company filed suit regarding a patent issue. In their lawsuit, Hawk Technology Systems LLC claims that a California agency, Goodwill of Silicon Valley, has infringed upon a patent owned by Hawk Technology. In 2012, Hawk Technologies formed as a company in order to market products developed by its owner.
Apparently Hawk Technology has patent related to a specific manner in which stores monitor and store video camera data. In its lawsuit, Hawk Technology indicates that Goodwill of Silicon Valley has infringed by using a method that is very much like the one for which Hawk has a patent. This usage is without Hawk Technology's permission. In its lawsuit, Hawk Technologies is seeking both damages and costs. Additionally, it has asked for a jury trial.
Texas businesses often apply for patents to protect their ideas, methods and property. When another company attempts to utilize patented items for their own purposes, there is the possibility that a claim for patent infringement can be made. In this case, consultation with an experienced patent law attorney may be in the company's best interest.
